Does this sound like a car that would be on the road if it wasn't MOT exempt?

Couldnt agree more dalbuie.There is going to be some scrappers being sold on ebay shortly. But there again no self respecting classic car owner would go on the road in a car like that.

I'm not so sure it would fail on those items, as long as the chassis and body mounts are solid and the corrosion is not within a certain distance of a stress point, and the steps are not hanging off, but as he hasn't shown those bits in the pic's it might be worse than that.

I suspect given his full description the car would have failed an MOT:

this is my austin big seven 1939 i was at the dvla office sharp on the 19th november so is taxed for a year.she runs lovely she is solid i sprayed her with cans.i have done approx 100 miles in the last few days and even took her to work on monday she needs welding in the o/s sill and both side steps need repairing i have changed the piston rings all lights work all original also original rear number plate v5 document present she is a cracker if i get the right price i will sell her.i have the right to stop auction at any time so happy bidding

My worry is the possibility of a serious crash in a car like this that will affect all respectable classic car owners.

My understanding was that to be MoT-exempt the pre-1960 car needs to possess a current MoT as of 18th November 2012.
If not it needs to undergo an MoT test which is still available voluntarily.

When looking at https://www.gov.uk/getting-an-mot/vehicles-exempt-from-mot it looks like you just need to fill in a V112 and take it along with your other documents.

I wrote the following on the pre 1960 MOT exemption thread earlier this year :

"I'm pretty sure that some unsafe wrecks will be on the road once more after decades perhaps of storage or abandonment"

Sadly it appears that I and others who had similar opinions were right .

His advert also states:

if i get the right price i will sell her.i have the right to stop auction at any time

Well, if there's a reserve, its meant to sell for anything over the reserve

My 58 rover was last on the road in April 2010, I taxed it online on Sunday morning without filling out forms etc, my disc arrived Wednesday this week.

I'm awaiting a new master cylinder for mine and I aim to drive it about 30 miles to get everything bedded in and shipshape and then its off to he MOT station for a voluntary test. I'm using the exemption as a way of getting mine ready for a proper MOT

Notwithstanding the presence or absence of an MOT certificate the Road Traffic Act 1988 makes it an offence to sell an un-roadworthy car. The Act does not distinguish between private sellers and motor traders.

I can't see anything structural at fault, provided the brakes and steering are ok it should not be as much of a hazard as the average 100 mph MOTd banger sold to any little scroat with a licence. Remember it's unlikely they will be driven at more than 40mph max.

I normally re-tax on line. I can't think that this form would be required in that case.

Just tried retaxing on-line, doesn't work. Seems not all cars have been sent the replacement V5.
